Member States
All 33 States of Latin America and the Caribbean are Parties to the Treaty of Tlatelolco and, therefore, Members of OPANAL.
Article 29, paragraph 1, of the Treaty of Tlatelolco (as amended) establishes that the instrument will enter into force between the States that have ratified it as soon as the following requirements have been met:
a. Delivery to the Depositary Government of the instruments of ratification of this Treaty by the Governments of the States mentioned in Article 26 that exist on the date on which this Treaty is opened for signature and that are not affected by the provisions of the paragraph 2 of Article 26 itself.
b. Signature and ratification of Additional Protocol I annexed to this Treaty, by all extracontinental or continental States that have, de jure or de facto, international responsibility over territories located in the Area of application of this Treaty.
c. Signature and ratification of Additional Protocol II annexed to this Treaty, by all powers that possess nuclear weapons.
d. Conclusion of bilateral or multilateral agreements on the application of the Safeguards System of the International Atomic Energy Agency, in accordance with Article 13 of this Treaty.
For its part, paragraph 2 of Art. 29 of the Treaty of Tlatelolco stipulates that:
It will be the imprescriptible power of every Signatory State to waive, in whole or in part, the requirements established in the previous paragraph, by means of a declaration that will appear as an annex to the respective instrument of ratification and that may be formulated at the time of deposit of this or subsequently. For States that make use of this power, this Treaty will enter into force with the deposit of the declaration, or as soon as the requirements whose waiver has not been expressly declared have been met.
